This privacy policy sets out how Classic Group collects, uses and protects your information.
Classic Group Master Privacy Policy
Classic Builders Group Ltd, Classic Group Trading Ltd, Classic Group Investments Ltd and Classic Super Holdings Ltd and their subsidiaries (“Classic Group” and/or “we, us, our”) collects ‘Personal Information’ to improve and personalise our services to clients, as well as complying with the Privacy Act 2020, our reporting entity obligations under the Anti-Money Laundering and Countering of Financial Terrorism Act 2009, and other regulatory or compliance obligations.
This Privacy Policy explains how our clients, prospective clients, other visitors, contractors’, and sub-contractors’ personal information is collected, used, protected, and disclosed.
By engaging with our business, utilising our services, communicating with us via email, online forms, phone, or social media, or participating in our events or promotions, you understand that we may collect, use, and disclose your personal information as described in this Privacy Policy.
Personal information
Personal information is information about an identifiable individual (a natural person) or by which a person’s identity can be reasonably determined. Classic Group collects personal information about you for a number of reasons. The personal information we collect depends on the business you engage with, and how we use it differs depending on our relationship with you.
We do not and will not sell personal information to any other party, and we will make sure that any personal information you give us is stored securely and used appropriately.
Why do we need your personal information?
We will only gather data essential for the provision of our products or services or as mandated by legal obligations. You have the right to choose not to supply personal information; however, please note that this decision may impact on our ability to provide you with products and services, or the services provided may not be as suitable or pertinent as they could be.
When do we collect your personal information?
Whenever possible, we collect personal information directly from you.
We may collect personal information during a telephone call, a face-to-face meeting, interacting online, or when exchanging emails with you. With your consent, we may also collect personal information from others, such as your family, accountants, lawyers, brokers, and agents. We will collect your personal information when you fill out a website registration or enquiry form.
We may also collect your personal information from publicly available sources, for example, to carry out customer due diligence or as part of providing services to you. We will always collect your personal information in a way that is legal and reasonable.

When you enquire about and purchase a residential home or residential land with Classic, the personal information we collect about you may include:
• Name
• Date and/or place of birth
• Address (email, physical, and postal)
• Contact phone numbers
• Documents that verify your identity and other personal details: such as your passport, driver’s license, or photo identification
• Financial information (as required to help us determine the best way to assist you)
• Residency status (as required when purchasing under the Overseas Investment Act 2005)
• Any other personal information relevant to the service we are providing you or that you provided during communication with us
• Details of lawyers, accountants, and real estate agents
• Any other personal information relevant to the service we are providing you or that you provided during communication with us or as required by law.
If you purchase an Occupational Rights Agreement in any of our retirement villages, we may additionally gather the following information from you:
• Family details including Next of Kin and emergency contact information
• Vehicle details including motorhomes and caravans to be brought into the village
• Details concerning your well-being and medical history that you may have provided to us to support and service you, including details of your medical providers
• Financial information necessary for processing your application, including enduring powers of attorney, along with bank account details and details of any property assets sold or to be sold to facilitate the purchase of the Occupational Right Agreement
• Hobbies, interests and memberships
• Any information regarding your personal circumstances and living necessities, such as the presence of pets or allergies
• Any details of events that occur while you are a resident of our village, such as a medical event and the response to that event
• Records of site use and access date, time, and location
• CCTV footage for the sole purpose of ensuring safety and security
• Any information conveyed through communication with our team.
When you enquire about and invest with Classic Group, we may additionally gather the following information from you:
• Financial information, including statements to prove your investor status
• For an individual: We may collect personal information such as your name, date and place of birth, address (email, physical, and postal), contact phone numbers, identification, and address verification
• For a company or incorporated society: We may collect personal information about the organisation’s (or a related company’s) officers, directors, shareholders, or employees, or about you personally if you are a sole trader or in a partnership. This may include names, addresses contact numbers, identification, and address verification
• For a trust: We may collect personal information about the trust’s settlor(s), trustees and beneficiaries, including names, addresses, contact numbers, identification, and address verification
We are required by law to collect information to enable us to comply with our obligations under anti-money laundering and countering financing of terrorism laws. This includes verifying our client’s identity, and the identity of relevant persons in a client’s organisation. To do this we may require you to provide identifying documents and information about yourself and individuals and/or entities associated with you (such as directors, shareholders, and beneficial owners). From time to time, we may ask you to provide updated versions of this information. To meet our obligations, we may require a third-party data supplier to verify the identity information you supply.
When you enquire about and purchase property management services with Classic Group, we may additionally gather the following information from the tenant and/or landlord:
• Documents to support your application form including occupation, employer details, and proof of income
• Property information including valuation and insurance details
• Financial information including billing and bank account details
• References in relation to supporting rental arrangements
• Vendor/supplier details, procured to manage and deliver products and services related to vendor/supplier contractual obligations.
We use the information we collect to provide you with the information, products, and services you’ve requested from us. Where applicable, we use your information to:
• Deliver our products and services to you or to respond to your requests for information
• Provide you with updates and information that may impact you
• Understand our consumers’ behaviour to continue to improve our client experience
• Conduct market research to help design and deliver new and improved products and services
• Suggest other products and services you may be interested in across Classic Group, or inform you about new products, services, or features
• Communicate with you about information, products, services, and events we think you might be
interested in.
• Provide you with updates and information that we believe may impact you
• Comply with legal and regulatory obligations
• Engage with third parties on your behalf or at your request
• Enforce our, or our clients’, rights and interests
• Carry out other specific actions or purposes, if you consent to them.

We will only disclose your personal information in a way that is for the purpose for which we collected it. Where applicable, your information may be disclosed:
• To Classic Group employees who require it to perform their jobs
• To other entities within the Classic Group
• To agents or service providers we employ to help us deliver services and monitor performance obligations
• To any person or entity you have requested or authorised us to disclose your personal information to, including those with enduring powers of attorney and nominated next of kin
• In response to a serious individual or public health and safety threat
• To an external party, such as a government entity, a regulator, or a law enforcement agency, if required or authorised by law; or
We will make sure that anyone we disclose personal information to is contractually bound, or we will use our best endeavors to ensure that recipients of personal information will only use it for the purpose for which we shared it with them.
If you are a client, we may need to disclose personal information in order to provide you with advice or services you have engaged us to provide. Which personal information and who we need to disclose it to will depend on the nature of the advice or services we are providing. Some examples include:
• If the matter relates to a sale or purchase of property or to a lease, we may need to disclose personal information including names, contact details, copies of identifying documents and financial information to financial institutions (such as banks), accountants, brokers, real estate agents, insurers and to the other party to the transaction (and their advisors);
• If the matter relates to a trust, we may need to disclose information including names, contact details, a copy of the trust deed, information about trustees and beneficiaries and financial information about the trust (which may be considered financial information about its settlor(s) and/or beneficiaries) to trustees and/or beneficiaries of the trust, the trust’s advisors or to other parties the trust is
transacting with;
• If the matter relates to an investment, we may need to disclose information such names, contact details, bank account details, Inland Revenue number and previous investment history to the entity offering the financial product;
• If the matter involves unpaid debts, we may need to disclose information such as names, contact details and invoices to enforce our legal rights or to notify credit agencies;
• If any transactions with you appear suspicious or unusual, we may be required by law to report these transactions to a governmental or regulatory authority.
When you instruct us to act on our behalf, we will be able to give you further details on what personal information we may need to disclose and who we may disclose the information to.
Your communication history with us
We may maintain a history of all communications between you and Classic Group to help ensure we provide the best possible service. This can include:

• Information you have provided to us about your preferences, your awareness of our brands, and your feedback from satisfaction surveys
• Any emails or other correspondence relating to any services you have sought from us or complaints or concerns you have raised with us

Classic Group uses this information to understand how people are using our websites and to improve them. We also use third-party cookies and other technology to gather analytics and advertise to you online. These allow vendors such as Google and Facebook to show ads from us to you on other internet sites and platforms. These activities use cookies to optimise and inform ads based on your visits to our websites. Information collected may include your IP address, search terms you use, pages you access and links you click on, your operating system, and your browser type.
Social Media
If you interact with us on social media—if you comment, follow, like, or mention us on platforms such as LinkedIn, Facebook, or Instagram— we will have access to your interactions and your profile information. We get this information from our interaction with you or from the social media platform. We use this information to communicate with you, for example, by responding to your comments or to advertise to you in the way we have discussed above in our cookies section.
Collection of images and videos
Classic Group and its associated companies use photographs and videos of a range of people for marketing and promotional purposes. This includes clients, residents, employees, and suppliers and contractors of Classic Group and its associated companies.
These images will be used for promotional and advertising purposes across various media, including but not limited to websites, social media platforms, email newsletters, and printed materials. Consent will always be obtained from the individuals included in photographs or videos via the Classic Group standard release form.
Classic Group occasionally hosts events and seminars where a photographer may be present to capture photos for marketing purposes. We will endeavor to notify attendees about the presence of photographers and the intended use of the images. While we prioritise transparency, in cases where photos are taken in public spaces, we reserve the right to capture and utilize these images without individual permission. For events held in more private venues, attendees will be informed about the presence of photographers and the intended image usage. Attendees of private functions have the right to withhold consent for the use of images featuring them for marketing purposes.
Copyright of all images will remain with the Classic Group and stored at the head office located at 160 17th Avenue, Tauranga, 3112.
Holding information
We retain your personal information in our systems for the benefit of our clients. This information is stored either by third-party specialist service providers or within our in-house systems. Typically, personal information is stored electronically.
Our systems are diligently safeguarded according to the security measures outlined in our policy. Additionally, all external service providers are legally obligated to handle personal information in full compliance with the Privacy Act.
When personal information is no longer required to be kept for business purposes or we are no longer legally required to keep it, the information will be disposed of in accordance with the Classic Group Content Retention and Destruction Policy.
Protecting Your Personal Information
We prioritise the security of our clients’ personal information and take all reasonable measures to protect this information from loss, unauthorised access, and misuse.
To achieve this, we have the following safeguards:
• Enforcing internal privacy policies designed to educate staff on their responsibilities and obligations under the Privacy Act for data protection and security
• We limit physical access to clients’ files solely to our employees
• Requiring third-party providers to have acceptable security measures in place before accessing any personal information
• Implementing robust cyber security measures to protect data integrity and prevent unauthorised access
• Adhering to the requirements of Section 50 of the AML/CFT Act to ensure the proper destruction of personal information when necessary
• All of our employees and contractors are obligated to maintain strict confidentiality regarding the information they handle
• We employ passwords, firewalls, and virus protection to safeguard the integrity of our information technology systems holding your data
• Any service providers handling personal information are contractually bound to comply with the Privacy Act, and we periodically verify the adequacy of their information security management.
Accessing and correcting your personal information
Subject to some exceptions, you have a right to access and correct the personal information we hold about you. You can check or update the information we have about you by emailing us at:

Please include evidence of who you are and the details of your request. Note that you are permitted to access or manage only your own personal information. Should you require access to or management of information on behalf of another individual, their explicit consent is necessary. In such cases, we may require verification of your identity and authority before addressing your request.
If we think a request for correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to make a note of the correction that you requested.
